Terms and Conditions

Please read these Terms & Conditions (“Agreement”) carefully before using the services provided by SleepMedRx LLC (“Provider”). This Agreement sets forth the legally binding terms and conditions between the Provider and the individual or entity (“Buyer”) signing or electronically accepting this agreement, or any other Order that references this agreement. This Agreement is entered into on (a) Buyer clicking “Accept”, “Agree”, "Checkout", and(or) “Yes” to the terms of this Agreement to proceed with the purchase of the Provider’s Services, and (b) upon initial receipt of payment from Buyer for any Service and(or) Products purchased from Provider. The Provider reserves the right to change this Agreement at any time.

1. Definitions

“Practices” are providers that are contracted through Provider to provide sleep medicine Services and Products.

“CPAP.com”, is the Doing Business As (DBA) name for the Texas incorporated company, US Expediters, Inc., that contracts with Provider to provide sleep medicine Services and Products.

“Referral Link” is the unique URL that the Buyer clicks on to be redirected to a page on the Provider’s website for specific Practices or CPAP.com.

“Sleep Specialist” is a board-certified doctor, nurse, and(or) sleep professional who diagnoses and treats sleep disorders. 

“USD” refers to the currency of the United States Dollar.

“Disposable Night Owl Mini Home Sleep Test” The architecture of the NightOwl device is a downsized version of polysomnography for OSA detection that yields an accurate OSA diagnosis. The NightOwl device collects sufficient data without attaching multiple probes connected by wires to your body.

“Sleep Test Interpretation” The review and scoring of the sleep test by a board-certified sleep physician, that will determine if sleep apnea is present and if so what type of apnea you have based on the recorded episodes.

“Prescription” A prescription is an instruction written by a medical practitioner that authorizes a patient to be issued with a medicine or treatment. A prescription in this order can refer to the home sleep apnea test, and or CPAP, BI-PAP, Oral appliance, or other treatment options discussed between patient and provider.

“Therapy” Therapy can refer to a CPAP, BI-PAP, Oral appliance, weight loss, and or other Options discussed between patient and provider.

“DocViaWeb.com” is the software utilized for the telemedicine visit  and to storeall clinical and medical records related to the patient’s visit with a Provider specialist.

“Telemedicine Visit” A video-based visit done via smart phone, tablet, PC, or any other electronic device with video capabilities between a patient and provider. The visit is done virtually through a HIPAA secure video platform used in the software DocViaWeb.com

“Appointment Time” The time the patient is scheduled with a SleepMedRx specialist. A reminder will be sent for all appointments with the time and instructions on how to login to the appointment.

“Regular Standard Rate” is the settled payment amount from Buyer to Provider, the amount for a Nurse Practitioner is $99.00 USD, and with a Medical Doctor is $125.00 USD.

2. Services & Pricing

By purchasing services offered by the Provider, Buyer agrees to pay a total amount of $174.99 USD if the Buyer clicks through on any Referral Link referencing CPAP.com, or $249.00 USD if the Buyer clicks through on any Referral Link referencing other Practices that Provider works with, by purchasing, the Provider will provide to the Buyer the following:

  1. One (1) Telemedicine visit from a Provider Sleep Specialist. 
  2. One (1) Disposable Night Owl Mini Home Sleep Test with one night of testing.
  3. One (1) Sleep Test Interpretation.
  4. A Prescription for Therapy as Clinically Indicated.

3. Scheduling & Visit Requirements

After the completion of a purchase by Buyer, Buyer is required to complete the patient profile on DocViaWeb.com and schedule a date and time for a Telemedicine Visit with a Sleep Specialist Provider before Provider ships any Home Sleep Test Equipment to Buyer.

Once Buyer schedules a Telemedicine Visit with a Sleep Specialist Provider, Buyer is responsible to attend the Telemedicine Visit within the first 10 minutes of the scheduled Appointment Time. In the event Buyer fails to attend the Telemedicine Visit within the first 10 minutes of the scheduled Appointment Time, and(or) if Buyer fails to cancel the Telemedicine Visit more than 24 hours in advance of the scheduled Appointment Time, Buyer will be required to purchase another Telemedicine Visit from the Provider at the Regular Standard Rate of a Telemedicine Visit.

4. Alternate Device Option

In the event Buyer does not medically qualify for the Night Owl Mini Home Sleep Test, the Provider will offer Buyer the option to test with an alternate home sleep test device at a standard rate of $199.00 USD.

5. Refund Policy

In the event Buyer does not medically qualify for the Night Owl Mini Home Sleep Test, and Buyer elects to not test with an alternate home sleep test device, Buyer will be refunded the amount of $49.99 USD from the Provider.

6. Limitation of Liability

The Provider shall not be liable for any damages, including but not limited to direct, indirect, incidental, special, or consequential damages arising out of or relating to the use of the services provided, even if advised of the possibility of such damages.

7. Governing Law

The Agreement shall be governed and constructed in accordance with the laws of the jurisdiction in which the Provider operates.

8. Severability

If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
